About

Kary brings over 15 years of combined litigation and e-discovery project management experience to help guide clients through the discovery process in lawsuits and regulatory compliance matters. He specializes in working with clients to develop solutions for collecting, analyzing, and producing data at all stages of the legal process.

Kary possesses extensive familiarity with a variety of the leading e-discovery project management tools, which he uses to develop cost-saving strategies for early case assessment, data analysis, document review, and production that are specialized to individual clients’ case needs. He also advises clients on data retention and preservation as well as the protection of data through the use of carefully crafted confidentiality agreements, protective orders, and privilege logs.

Kary lives in Denver with his wife and son. Away from the office, he enjoys traveling, running, skiing, and spending time in the beautiful Colorado outdoors.

  • After taking over a case from prior counsel following an adverse ruling on a motion to compel, Kary designed a custom workflow to facilitate the collection and production of over 500,000 documents in a week, all while withholding privileged documents. The documents Kary guided through the production process provided compelling evidence supporting the client’s narrative of the case. The opposing party, who was counting on using the client’s inability to produce documents in the court-ordered timeframe as leverage for resolving the case in their favor, quickly settled on terms favorable to Kary’s client.

  • As part of a team representing a large multinational automobile manufacturer in a series of hundreds of franchise disputes with local dealerships, Kary spearheaded the review and production of documents in dozens of individual arbitration matters. Kary used the produced documents as evidentiary support in drafting the arbitration briefs, as well as handling the briefing on all discovery disputes. Kary’s team went undefeated for the client in arbitration hearings.

  • Kary led multiple first-pass and quality control document review projects in connection with a high-profile multidistrict product liability class-action matter for an appliance manufacturer. Kary developed institutional knowledge of the client’s documents, allowing him to closely consult on deposition and trial exhibit selection. Kary then provided real-time support for evidentiary disputes immediately before and during the trial. Based on a document record showing the appliance manufacturer’s careful adherence to product design standards, the jury returned a complete defense verdict in the case.
